Outlook

Part of A 2027 franchise outlook for England, with dated signals and triggers that force a rethink

Three 2027 compliance checks for a franchise buyer in England

Three 2027 compliance checks for a franchise buyer in England: Making Tax Digital scope, AI used with customers and local permissions, each with an owner.

Three of the 2027 planning signals turn into tasks for a franchise operator: tax records, customer-facing AI and local permissions. They are not predictions of franchise sales or profit. Each has an owner, something to check and a trigger that tells the buyer when to check again. The wider 2027 outlook covers the rest.

What to take away

  • Three signals become operator tasksdigital tax records, AI used with customers and local permissions.
  • Making Tax Digital applies from 6 April 2027 to relevant sole traders and landlords with qualifying income above £30,000.
  • A business remains responsible for an AI agent used with customers.
  • A broad national opportunity can still be constrained by one English council area, premises or operating condition.
  • Set each next check from the source and the decision risk, not from one quarterly reminder.

Tax records: confirm scope before 6 April 2027

Digital tax work is a matter of eligibility, not a general software trend. HMRC's Making Tax Digital guidance states that those with income over £30,000 will be mandated from April 2027.

From 6 April 2027 the phased requirement applies to relevant sole traders and landlords with qualifying income above £30,000. Company franchisees and other situations need their own analysis. Ask a tax adviser to confirm scope, then test records, agent access and corrections before the start date.

AI with customers: responsibility stays with the business

A business remains responsible for an AI agent used with customers. The CMA published guidance on consumer law and AI agents in March 2026. Its Complying with consumer law when using AI agents guidance says that if an AI agent you use does something illegal, you are responsible.

The guidance addresses transparency, testing, monitoring, correction and human oversight. A franchise should pilot one bounded task that can be reversed, and record errors plus checking time. A vendor's productivity statement is not a local result. Reassess when the model, prompt, data source or customer journey changes.

Permissions: one council area can decide

GOV.UK's Find a licence service searches by activity and location but says its catalogue may be incomplete. That means a broad national opportunity can still be constrained by one English council area, premises or operating condition.

The authority depends on the activity. Selling alcohol or late-night refreshment needs a premises licence under the Licensing Act 2003. A change of use or a new shopfront may need planning permission, and a food business registers with its local council. Ask the council which of these applies.

Maintain a permission register for every planned site, as part of the market entry checklist. A change in format, hours, product, ownership or premises should trigger confirmation with the authority rather than reuse of another outlet's answer.

Record who asked, on what date and what the authority said, so the answer can be traced later. A permission that cannot be traced to a named authority and a date should be treated as unconfirmed until someone checks it again.

Who confirms what, and when to check again

Each of the three signals runs on a different clock, so one calendar reminder cannot cover them. The table names who confirms each signal and what moves the next check.

Record the release cadence behind each signal. Tax guidance changes on a different timetable from a local consent, which may change only when the activity or premises does. A single quarterly reminder is therefore inadequate. Set the next check from the source and decision risk, then keep the earlier observation for comparison.

Give each check an owner

Assign each signal a source owner, a review date, a model assumption and an action threshold, and name the accountable role for each. Separate observed data from a government forecast or management scenario.

Keep the local unit's numbers beside the watchlist. If a tax, AI or permission result would change a cost or demand assumption, trigger a model review once that assumption leaves its agreed range.

Before you act

  • Ask a tax adviser to confirm Making Tax Digital scope before 6 April 2027.
  • Test records, agent access and corrections before the start date.
  • Pilot one reversible AI task and record errors and checking time.
  • Keep a permission register for every planned site.
  • Set the next check for each signal from its source and decision risk.
  • Give each signal a source owner and an action threshold.

Common questions

Does Making Tax Digital apply to a company franchisee?

The phased requirement as stated applies to relevant sole traders and landlords with qualifying income above £30,000. Company franchisees and other situations need their own analysis, so ask a tax adviser to confirm scope.

Who is responsible when an AI agent errs with a customer?

The business that uses it. The CMA guidance says that if an AI agent you use does something illegal, you are responsible, so test, monitor and keep human oversight in place.

Can one outlet's permission answer be reused at another site?

No. A change in format, hours, product, ownership or premises should trigger confirmation with the authority rather than reuse of another outlet's answer.
